1. These terms

These Terms of Use are an agreement between you and Pencil Learning Technologies, Inc. ("Pencil", "we", "us" or "our"). They cover the Luna – Learn Anything app on iPhone, iPad and the web, the heyluna.com website, and the tutoring, courses and other features we offer through them (together, "Luna").

By signing in to or using Luna, you agree to these terms. Our Privacy Policy explains how we handle personal information, and is part of these terms. If you don't agree, please don't use Luna.

2. Who can use Luna

  • Accounts: you sign in to Luna with a Google account. You're responsible for keeping that account secure and for what happens in your Luna account. Tell us straight away at support@heyluna.com if you think someone else is using it.
  • Accurate details: give accurate information when you set up your account, especially your birth month and year, because Luna uses them to choose the right experience and protections for your age.
  • Learners 13 and under: may use Luna only after a parent or legal guardian invites them, approves their account and gives consent.
  • Learners under 18 (or under the age of majority where they live): may use Luna only with the permission of a parent or legal guardian, who should review these terms with them.
  • Parent accounts: are for adults who are the parent or legal guardian of the learners they link to.
  • You can't use Luna if we've previously removed you from it, or if the law where you live doesn't allow it.

3. Family accounts

A parent or guardian can invite a learner under 18 to link their accounts. While linked, the parent can see the learner's progress and session recaps, as described in our Privacy Policy.

When you invite, approve or give consent for a learner, you confirm that you're their parent or legal guardian, that the details you give are accurate, and that you agree to these terms on the learner's behalf. You're responsible for the learner's use of Luna. A parent can disconnect a link or delete a linked learner's account in Settings at any time.

4. What Luna is, and isn't

  • An AI tutor. Luna's tutor, recaps, diagnostic results and suggestions are generated by artificial intelligence. They can be wrong, incomplete or not suited to you. Check anything important with a teacher or another reliable source.
  • Learning support, not professional advice. Specialist tutors, such as essay coaching and college counseling, give general educational guidance. They're not a substitute for a teacher, school counselor or other professional.
  • No guaranteed results. We don't promise any particular grade, score, competition result or admission outcome.
  • Luna will change. We add, change and remove courses and features. We may limit how much you can use some features, and Luna may sometimes be unavailable, for example during maintenance.
  • Reminders. Reminders are there to help, and depend on your device and email provider. Don't rely on them for anything time-critical.

5. Using Luna responsibly

Luna is for learning. When you use it, you agree not to:

  • use Luna during a test, exam, competition or other assessment where outside help isn't allowed, or hand in Luna's work as your own where your school or the event doesn't allow it;
  • upload or share anything illegal, harmful, hateful, sexual, violent or harassing, or anything you don't have the right to share;
  • share another person's personal information, including in a homework photo, without their permission;
  • try to make the AI produce harmful or inappropriate content, or get around its safeguards;
  • get around Luna's age checks, parental consent, or other protections, or pretend to be someone else;
  • copy, scrape, resell or commercially exploit Luna or its content, or use automated tools to access it;
  • reverse engineer Luna except where the law allows it, or interfere with, overload or disrupt Luna or its security;
  • break any law, or help anyone else break these terms.

If you see something unsafe or inappropriate in Luna, please tell us at support@heyluna.com.

6. Your content

"Your content" means what you put into Luna, such as answers, messages, voice, drawings and homework photos. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt and display it, and to share it with our service providers, but only to run, secure and improve Luna as our Privacy Policy describes. This license ends when your content is deleted, except for copies we need to keep by law or that remain for a limited time in backups.

Make sure you have the right to upload what you share. Photographing a question from your own textbook or worksheet for personal study is fine. Don't upload sensitive information that Luna doesn't need, such as health details or identity documents.

If you send us suggestions or feedback, we can use them without owing you anything.

7. Luna's content

Luna, including its software, design, courses, explanations and the AI tutor's responses, belongs to Pencil or our licensors and is protected by law. As long as you follow these terms, we give you a personal, non-exclusive, non-transferable, revocable license to use Luna for your own non-commercial learning.

Some courses help learners prepare for competitions and use problems from them. Competition names, such as AMC, AIME, the International Linguistics Olympiad and the MIT Integration Bee, belong to their owners. Luna isn't affiliated with or endorsed by those organizations.

If you think something in Luna infringes your copyright, email support@heyluna.com with the work you believe is infringed, where it appears in Luna, your contact details, and a statement that your complaint is accurate and made in good faith. We'll review it and remove material where appropriate.

8. Fees

Luna is currently free. If we introduce paid features, we'll show you the price and any extra terms before you buy, and nothing will be charged without your agreement. Purchases made through Apple's App Store are handled by Apple under its terms.

9. Other services

Luna works with services from other companies, such as Google Sign-In. Your use of those services is covered by their own terms and privacy policies. Luna may also link to other websites, which we don't control and aren't responsible for. Tutoring sessions run on Pencil Spaces, our own learning platform, and are covered by these terms when you use them through Luna.

10. Apple app terms

If you got Luna from Apple's App Store, these extra terms apply:

  • These terms are between you and Pencil, not Apple. Pencil, not Apple, is responsible for Luna and its content.
  • You can use Luna on Apple devices that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for Luna.
  • If Luna fails to meet any warranty that applies, you can tell Apple, and Apple may refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Luna.
  • Pencil, not Apple, is responsible for any claims relating to Luna, including product liability, legal or regulatory claims, consumer protection claims, and claims that Luna infringes someone's intellectual property.
  • You confirm that you're not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

11. Ending your use

You can stop using Luna at any time, and delete your account in Settings. We may suspend or close an account, or limit access to Luna, if we reasonably believe someone has broken these terms, put others at risk, or created legal risk for us, or if we stop offering Luna. Where it's reasonable, we'll tell you first and explain why. Sections 6, 7 and 12 to 17 continue to apply after your use ends.

12. Disclaimers

To the fullest extent the law allows, Luna is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and that Luna will be uninterrupted or error-free.

Some places don't allow these disclaimers, so they may not apply to you. Nothing in these terms limits rights you have as a consumer that can't be limited by contract.

13. Limits on liability

To the fullest extent the law allows, Pencil won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, opportunities or goodwill, arising from or related to Luna or these terms. Pencil's total liability for all claims related to Luna or these terms is limited to the greater of US$100 or the amount you paid us for Luna in the 12 months before the claim.

These limits don't apply to liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud.

14. Indemnity

If you're an adult, you agree to defend and compensate Pencil for claims, losses and costs, including reasonable legal fees, that arise from your content or your breach of these terms, or, for a parent, the use of Luna by a learner linked to you. This doesn't apply to the extent the problem was caused by us.

15. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. Before starting a formal dispute, please email support@heyluna.com so we can try to resolve it informally. Any dispute that can't be resolved informally will be heard only in the state or federal courts located in California, and you and Pencil agree to those courts' jurisdiction.

If you live in the European Economic Area, the United Kingdom or another place whose consumer laws give you the right to use the laws and courts of your home country, these terms don't take that right away.

16. Changes to these terms

We may update these terms as Luna changes. When we do, we'll change the version and effective date at the top of this page. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using Luna after the change takes effect, you accept the new terms. If you don't agree, you can stop using Luna and delete your account.

17. General

  • These terms and the Privacy Policy are the whole agreement between you and us about Luna.
  • If any part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a part of these terms straight away, we can still enforce it later.
  • You can't transfer these terms to anyone else. We can transfer them as part of a merger, acquisition or sale of assets, or to a company in our group.
  • We're not responsible for delays or failures caused by events outside our reasonable control.
